F J Brown & Co and its employees act as data processor and data controller for the purpose of the General Data Protection Regulation (GDPR) in respect of personal data supplied to us in order to provide the Professional Services.

Each time we collect personal data from you we will include a link to this privacy policy so you understand how your data might be used. We will also give you the opportunity to opt-in or out of certain data uses by us.

How you send information to us is your choice but please be aware that some methods are not secure.

WHAT TYPE OF INFORMATION DO WE COLLECT?

In order for us to provide Professional Services we may collect the following information from you that relates to the professional mater that we are instructed on:

  • Name of the client;
  • Client’s organisation or business name;
  • Contact information for the client (e.g. address, email address, telephone number);
  • Case details (which may include, personal information relating to third parties involved in the case; further personal information relating to the Client etc.) You will usually be the source of any personal information that we hold.

HOW IS YOUR INFORMATION USED?

We require this information in order to contact you, as the client, to discuss and deliver projects in line with our mutual contracts. We will not use that same data for an unrelated purpose, such as sharing it with a marketing agency. With your permission, we may share your information with associates and contractors to provide other services (such as construction quotes, structural engineering calculations or planning advice) in line with the agreed project.

All personal information that we collect in relation to the provision of Professional Services will be recorded, used and protected by us in accordance with applicable data protection legislation and this Privacy Notice.

The legal bases that we rely upon are that:

  • The processing is necessary for the performance of the contract to provide the Professional Services to the Client;
  • The processing is necessary in order to comply with legal obligation to which we are subject, such as, complying with investigations by the Royal Institution of Chartered Surveyors (RICS), or any other statutory regulator; and/or
  • The processing is necessary for the purposes of legitimate interests pursued by us, such as, for the purpose of conflict checking, for the use in defence of potential complaints, legal proceedings or fee disputes or fee recovery, or for otherwise complying with our professional obligations set out within the RICS Rules of Conduct for both Firms and Members.

WHO HAS ACCESS TO YOUR INFORMATION?

 

We limit access to your personal data to those who have a genuine business need to know it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality. We retain client record including all drawings, models, information, data and correspondence for 7-12 years post contract period and any limitation extension. This is to be able to respond to any legal claim or similar. However, under the GDPR personal data may be erased earlier than this, if there ceases to be any ‘legitimate interest’ to process the data.

YOUR CHOICES & RIGHTS

You have legal rights under the ‘data protection regulations’ in relation to your personal data. These are as follows:

  • You can ask us to confirm whether or not we have and are using your personal data.
  • You can ask that we rectify any information about you which is incorrect.
  • You can ask that we erase your personal data if you withdraw your consent to us using your information.
  • You can object to any use of your personal data if you believe your fundamental rights and freedoms to data protection outweigh our legitimate interest in using the information.
